Verifying Employees who are Eligible to Participate in the Washington State Retirement System
- Determine if any employees/
contractors are retirees of a Washington state retirement system.If you find that you have retirees on your list, review their personnel files to ensure that you have a written statement from them that they are retired from a retirement system. Employers are required under RCW 41.50.139 to document if new employees have ever been retired from a Washington state retirement system. Employees are required to report all of their past service.
You must also ask for the retirement status of any contractor, independent contractor, or personal service contractor that you directly compensate. We have created a Contractor Status form for you to use with Member Reporting Verification (MRV) to review their status. If you see the following message displayed: “Retired under the 2008 early retirement factors. Stricter return to work rules apply,” contact Employer Support Services immediately for reporting instructions. If this message is not displayed, document and retain the form.

You are not required to verify the status of vendor companies, their employees and subcontractors. Vendor companies are hired through your normal bidding process. Review DRS E-mail 09-001 & DRS E-mail 08-014.
Review the Retirement Status Form. Most retirees must wait at least 30 days from their retirement date (accrual date) not separation date, before returning to work or their retirement benefit will be stopped.
Review the Retiree Returning to Work Reporting Chart.
Make a list of the hours (by month) that the retiree worked for the audit year. Determine if the retiree is working in an eligible or ineligible position and report them accordingly.
