Employer reporting change for DRS retirees who return to work in a position eligible for a Higher Education Retirement Plan (HERP)

Retiree return to work (RRTW) rules will change beginning January 2012, due to the passage of ESHB 1981 in the 2011 Legislature.

Beginning January 1, 2012, DRS retirees from the Public Employees’ Retirement System (PERS), Public Safety Employees' Retirement System (PSERS), School Employees’ Retirement System (SERS), and Teachers’ Retirement System (TRS) working in HERP-eligible positions are subject to annual hourly work limits. In the past, most RRTWs working in HERP-eligible positions were reported to DRS as working in an ”ineligible position” and were not subject to annual hourly work limits. In order to comply with the requirements of ESHB 1981 changes to reporting are necessary.

Reporting Changes

  • All RRTWs (except retirees of TRS Plan 1)
    DRS retirees who are currently working for you in a HERP-eligible position must be reported to DRS as working in an “eligible position” (Plan 0, Type Code 98) effective January 1, 2012.
  • TRS Plan 1 RRTWs
    No change. Continue to report TRS Plan 1 RRTWs in Plan 0 with Type Code 97.

Communication to Retirees

In addition to changing your reporting, we need your help communicating to retirees impacted by this change. Please provide the attached letter to DRS retirees. Retirees from the Public Employees’ Retirement System (PERS), Public Safety Employees' Retirement System (PSERS), School Employees’ Retirement System (SERS), and Teachers’ Retirement System (TRS) working in HERP-eligible positions will be impacted. We can’t send these letters to retirees directly because we are unable to identify all RRTWs working in HERP-eligible positions.
