Effective: April 14, 2023 —July 1, 2026:
Retirees from the Public Employees’ Retirement System (PERS) and the Public Safety Employees’ Retirement System (PSERS) can now return to work up to 1,040 hours in a non-administrative licensed nursing position for a state agency or institution of higher education and still receive their benefit.
Requirements for the retiree to receive the exception
- The retiree must have waited at least 30 calendar days between their retirement date and returning to work.
- The retiree can only work in a non-administrative licensed nursing position.
If the retiree has retired from more than one DRS-covered retirement system or has a disability retirement, they should contact DRS to discuss eligibility before accepting employment.
Reporting change – new Type Code required
The new law requires a change to the DRS reporting structure. It will affect the Employer Reporting Application (ERA) and requires additional programming. You will need to start using Type Code 95 on Jan. 1, 2024:
